Franchise Law Concepts
Franchise laws are the legal issues between franchisee and franchisor, a buyer seller relationship case.
The franchise laws bring about different areas of the law regarding such particular relationship as well as the relationship of the franchisee to its employees and other third party elements.
In the franchise system, an individual acquires the right to sell the products and services of the franchisor. This is not similar to other resale systems because the seller only sells exclusively the franchise services and trademarks under the franchisor’s brand name. Franchise law is the system of legal procedures designed to regulate the relationship between the franchisee and franchisor.
Franchise law is regulated by federal statutes or in the US, is popularly known as the Federal Trade Commission or FTC. Additionally, each region enforces its own laws that affect the legal relationship of franchisors and franchisees within those areas. Courts can also render legal decisions that can have repercussions on the franchising system. Since there are various regional or state laws, franchise law interpretation can be varied from one state to another or even one country from another. A franchise law may be considered valid and must be enforced in its state of origin but it can be considered illegal and must not be practiced in a neighboring region.
Franchise law has developed its own distinctive body of law because of the very unique legal relationship of the franchisor and franchisee. Though franchise law has evolved and may be practiced in numerous areas, it has to be in conjunction with the existing laws of that particular area. To be adept with franchise laws, one must also be familiar with the following laws, business laws, contract laws, trademark laws, collections law, international law, administrative law and customs.
If you are ever considering on starting up or owning a franchise business, you need to consult first with an experienced franchise lawyer. Even during meeting with franchisors, make sure to employ the services of a franchise law expert so one cannot violate any franchise laws. It is better to get a lawyer specializing in this particular branch than an ordinary lawyer who has to catch up in recent franchise legislation.
